ARTICLE 1 – CONDITIONS OF APPLICATION
These general terms and conditions of sale define the conditions under which distance sales are concluded, particularly via the website https://www.domainedebournet.fr , by EARL Domaine de Bournet with individual consumers located in France and Europe. They constitute the law between the parties.
Any order placed by the customer implies their unreserved acceptance of these general terms and conditions of sale, which they acknowledge having read and understood prior to placing the order, either in the documents sent to them with the order form or on the website.

Earl Domaine de Bournet reserves the right to modify and update its general terms and conditions of sale at any time. These modifications and updates will be binding on the customer from the date they are communicated to the customer or published on the website.
The sale of alcohol to minors is prohibited. The customer confirms that they are at least 18 years old on the date of purchase.
Excessive alcohol consumption is dangerous for your health and alcohol should be consumed in moderation.

ARTICLE 2 – ORDERS – OFFERS.

The validity period of the product offers is that specified in the documents sent to the customer and on the website.

Once the customer feels sufficiently informed, they may then place their order, it being understood that by placing an order, they implicitly acknowledge having received all the desired information.
Due to their nature, the products sold by Earl Domaine de Bournet are limited in quantity and are only offered for sale while stocks last.
For any order placed via the website, the customer must follow the ordering process specified therein by completing the online electronic order form.
For other remote orders, the customer must return the order form that was sent to them, duly completed, to Earl Domaine de Bournet at the following address: Domaine de Bournet F-07120 Grospierres.
The customer provides the requested information, necessary for the completion of the sale and delivery, in the areas reserved for this purpose, taking care, on this occasion, not to omit any information essential to the proper execution of the delivery (access methods, door codes, landline telephone number, etc.).
After validation of the order and payment by the customer of the price thereof on the website and/or upon receipt of the order form accompanied by the customer's payment, the order is deemed final and the sale formed.
The order can no longer be cancelled or modified without the prior written consent of Earl Domaine de Bournet, subject to the customer exercising their right of withdrawal as described in these general terms and conditions of sale.
As an exception, Earl Domaine de Bournet reserves the right to cancel an order placed by a customer if the order appears abnormal with regard to the customer's true identity, the ownership of the payment method used, and the delivery address provided.
In this exceptional case, Earl Domaine de Bournet reserves the right to request, in writing (paper or electronic),
email to the customer all the required supporting documents regarding their identity, ownership of the payment method used and the requested delivery address.
If the customer fails to provide the requested evidence in writing, either on paper or by email, within 8 days of receiving the request from Earl Domaine de Bournet, the company will be entitled to cancel the order placed with them, informing the customer in writing, either on paper or by email, of its decision.
In the event of cancellation of the order, Earl Domaine de Bournet undertakes to reimburse the customer within a maximum period of 14 days from the date of cancellation of the order.
In the event of stock shortage, Earl Domaine de Bournet undertakes to inform the customer within a maximum of 3 working days from receipt of the order, offering the customer a product of equivalent quality and price.
The customer can then either cancel their order and receive a refund of the price paid, or order products of equivalent nature and price that may be offered to them.
In the event of cancellation of the order, Earl Domaine de Bournet undertakes to reimburse the customer within a maximum period of 14 days from the date of cancellation of the order by him.

ARTICLE 3 – DELIVERY AND TRANSPORT
Delivery is carried out by Earl Domaine de Bournet or by a carrier appointed by them to the address provided by the customer when placing their order. A delivery notice will be left for the customer if they are not present at the time of delivery.
Delivery of ordered products will be made within Metropolitan France (excluding Corsica and coastal islands), generally within 10 to 15 business days from the date of receipt of the order form and payment. For any order outside Metropolitan France
(Corsica and coastal islands, rest of the world), delivery will take place after specific agreement of the customer on the costs inherent to the delivery (customs fees, port taxes, …) and acceptance of the quote and full payment of the order and delivery costs.
If Earl Domaine de Bournet is unable to deliver the ordered products within the normal delivery time, the customer may then automatically cancel their order.
In this case, the customer must inform Earl Domaine de Bournet, which will then undertake to reimburse the customer, as soon as possible and in any event within 14 working days from receipt of the cancellation request, all sums which it may have received when placing the order.
Products sold by Earl Domaine de Bournet are shipped at its own expense, risk, and peril. The transfer of risk and responsibility occurs upon delivery of the products to the customer's premises at the address specified in the order. The customer agrees to be present to receive the delivery. In the event of missing, damaged, or non-conforming products, the customer must note their reservations in writing on the delivery slip with their signature and inform Earl Domaine de Bournet of these incidents by mail or email within 48 hours of delivery, in order to allow Earl Domaine de Bournet to preserve its rights against the carrier.

ARTICLE 4 – PRICE – PAYMENT
The prices of products listed on the website http://www.domainedebournet.fr and on Earl Domaine de Bournet's sales documents are inclusive of all taxes for sales made in France. For all orders outside mainland France, a quote will be sent beforehand, including the taxes and shipping costs associated with the order.
For all orders within mainland France (excluding Corsica and coastal islands), a shipping fee of €35 (including VAT) must be added to these prices, as indicated on the website and order form. This shipping fee is waived for orders over €350 (including VAT).
Payment for products ordered on the website is made directly on the website by cash, PayPal, credit card, check, or bank transfer at the time of order placement. Payment for products ordered using a paper order form is made by check, which must be included with the order form.
Addressed by Earl Domaine de Bournet. The invoice for the products ordered will be sent to the customer with their delivery.
Any payment incident will authorize Earl Domaine de Bournet to suspend the execution of all current orders and to refuse any new order from the customer, without the customer being able to claim any damages or compensation.

ARTICLE 5 – RIGHT OF WITHDRAWAL
In accordance with Article L 121-21 of the French Consumer Code, the customer has a period of fourteen clear days from the date of receipt of the ordered products to exercise their right of withdrawal. When the fourteen-day period expires on a Saturday, Sunday, or public holiday, it is extended to the next working day.
The customer undertakes to inform Earl Domaine de Bournet of the exercise of his right of withdrawal, within the period stated above, by mail or email or by returning the withdrawal form attached to the website.
In exercising their right of withdrawal, the customer may return the products ordered to Earl Domaine de Bournet, with the return costs of these products being borne by the customer.
The return of products must be made within 14 days of the information sent by the customer to Earl Domaine de Bournet regarding the exercise of their right of withdrawal, to the company's registered office address: Domaine de Bournet F-07120 Grospierres.
It is expressly stated that products subject to the customer's right of withdrawal will only be accepted if they are returned in their original packaging and in perfect condition for resale. Any product that has been damaged or partially opened will under no circumstances be eligible for the right of withdrawal provided for in this article.
Consequently, the customer is advised to keep the original packaging until the expiry of the withdrawal period and, when opening the package, not to damage the packaging provided.
In the event of the exercise of the right of withdrawal by the customer, Earl Domaine de Bournet undertakes to reimburse the customer for all sums received by him for the purchase of the products (including delivery costs), as soon as possible and at the latest within 14 days following the date of receipt of the products subject to the right of withdrawal at the premises of Earl Domaine de Bournet or the date on which the consumer provided Earl Domaine de Bournet with proof of shipment of these products.
The customer will be reimbursed either by credit to their bank account or by check, depending on the payment method used by the consumer.
If Earl Domaine de Bournet fails to reimburse the sums due to the customer within the aforementioned 14-day period, it will automatically be liable to the customer for the late payment penalties set out in Article L 121-21-4 of the Consumer Code, under the conditions stipulated therein.

ARTICLE 6 – WARRANTY AND LIABILITY
It is the customer's responsibility to verify that the products ordered correspond to their needs, it being specified that prior to placing the order, the customer had the opportunity to obtain detailed information from Earl Domaine de Bournet on the characteristics of the products ordered.
Given the nature of the products sold, customers are advised to store them in a location that ensures proper preservation, specifically away from sunlight, frost, and sudden temperature fluctuations. In accordance with the above provisions, Earl Domaine de Bournet guarantees the products sold against any defects or hidden flaws, under the conditions specified in Articles 1641 to 1648 and 2232 of the French Civil Code, and guarantees the conformity of the products under the conditions specified in Articles L 211-4 to L 211-13 of the French Consumer Code.
If the customer believes that the delivered products are defective, faulty, or non-compliant, they must notify Earl Domaine de Bournet by registered letter with acknowledgment of receipt as soon as possible after discovering the defect, fault, or non-compliance. The letter must specify the nature and extent of the alleged defect, fault, or non-compliance, as well as the batch number of the product in question, and provide all supporting documentation. The customer must allow Earl Domaine de Bournet every opportunity to carry out any investigations it deems necessary.
If, following these observations, it turned out that the delivered products were indeed defective, flawed or non-compliant, then Earl Domaine de Bournet would undertake to replace these products free of charge, to take charge of all the costs of returning these products and shipping products free from defects, flaws or non-compliance, or, failing to be able to replace the products, to reimburse the customer for the price of these products.

ARTICLE 7 – FORCE MAJEURE
Earl Domaine de Bournet may be released from all or part of its obligations without any claim for damages or compensation, if force majeure or fortuitous events occur preventing or delaying the delivery of the products ordered.
Events such as storms, fires, floods, etc., are considered to be cases of force majeure.

In the event of a force majeure event, Earl Domaine de Bournet undertakes to notify the customer as soon as possible by mail or email.
Earl Domaine de Bournet's obligations will then be automatically suspended, without compensation of any kind, from the date of occurrence of the event constituting force majeure until the date of its end.
However, if the impediment due to force majeure persists for more than one month, then the client may, if he or she sees fit, terminate the contract by registered letter with acknowledgment of receipt, without this giving rise to any damages or compensation for either party.
Earl Domaine de Bournet would then undertake to reimburse the client for all sums that would have been paid to him.

ARTICLE 8 – PERSONAL INFORMATION
The data recorded by Earl Domaine de Bournet constitutes proof of the order's content and date. This data is archived by Earl Domaine de Bournet and the customer has access to it. In accordance with the French Data Protection Act of 6 January 1978, as amended in 2004, the customer has the right to access, rectify, delete, or object to the processing of their personal data. To do so, the customer simply needs to submit a request.

ARTICLE 9 – APPLICABLE LAW
These terms and conditions of sale and all sales made by Earl Domaine de Bournet are governed by French law, which shall regulate any dispute relating to their interpretation, formation, and/or performance. In the event of a dispute, the Customer shall first contact Earl Domaine de Bournet to seek an amicable solution.
The Customer may submit any complaints on the online dispute resolution platform provided by the European Commission at the following address: http://ec.europa.eu/consumers/odr/ The European Commission will forward the Customer's complaint to the notified competent national mediators.
Failing that, the French courts will have jurisdiction.
